Pornography cases are similar to drug cases in that they generally involve warrants.  Often the also involve entrapment by the police.   They sometimes lure someone into talking online with an officer who pretends to be a young person.  Or they pretend to be someone interested in certain kinds of video or pictures.  These cases usually need to be defended on the basis of what the police did during the investigation.  How did they get the warrant to search the accused person, his computer or home and what information did the police give to the Judge who issued the warrant.  The information that the police provide in order to get a warrant is sometimes incomplete and often is designed to appear to be more robust than it really is. Pornography is usually found on electronic devices, computers , thumb drives, or cell phones. You may not even know that it is on your device.  It is key that the police are able to establish that you did know that pornography is on your device and they most often obtain that evidence by getting you to admit it.  They start talking to you asking you to explain and you admit that this is your phone, your computer or your had drive.  Then they get you to say that you knew that the pictures were on your device.  Don't say anything to the police.  You are not required to talk.  You have the right to remain silent.   You do  not look bad in front of a judge if you "did not take the opportunity to explain your side of the story."

You have heard that you have the right to remain silent.  You do have the right to remain silent and you should use that right.  This si the most important piece of legal advice that you will ever get and it is fee.  Never provide any information to a police officer.  Understand that nothing you say will be used for your benefit.  It will only be used against you.  Usually the police tell you that anything you say can and will be used against you in a court of law..  If the police are talking to you it is because they want to get you to say something that they can use.  If the police are talking to you they want you to talk because they need you to say something. Don't.  The only thing that you should ever say to a police officer is:  "I want to talk to my lawyer.  I have nothing to say to you."  Say this and only this over and over and over.
